Project-specific Advice

Operational Commercial Advice
A key process risk faced by any client employing a subcontractor in today’s construction sector is the risk of a “smash & grab” adjudication associated with payment.
As the recent court rulings (including: M Davenport Builders Ltd -v- Greer [2019] EWHC 318 (TCC), and Grove Developments Ltd -v- S&T (UK) Ltd [2018]EWCA Civ 2448) demonstrate, any failure to issue a valid payment and/or payless notice can have significant implications on operational cashflow.
